In this training session, our presenters will discuss:

When do operators need to pay residents their exit entitlements under the Retirement Villages Act;

What information should operators obtain before making any payment;

Dealing with outgoing residents or their families after the resident leaves the village
This training will help you understand the role of substitute decision-makers/representatives and break down the terminology. It will also provide you with an understanding of risks to consider when making exit payments and who you should be taking instructions from.
This 90-minute training session will cover:

The differences between a “guardian”, “financial attorney”, “medical treatment decision-maker” and “next-of-kin” (NOK) or “representative”.

Which decisions these people can make.
Eg, can a NOK sign a residence contract? can a NOK direct you if a legal personal representative has been appointed? who can make decisions after the resident leaves or dies? -
What options are available to you if you disagree with a direction from a legal personal representative?

Donna is a Principal at Russell Kennedy Lawyers in the Property and Retirement Living team with over 21 years’ experience. She advises owners, operators and developers of retirement village communities in relation to acquisitions and divestment of properties in the seniors living sector, legal compliance issues and preparation of resident contract documentation. Her experience also includes an 18-month secondment to Lendlease (now known as Keyton) to provide in-house advice on a major retirement village re-contracting project. Donna is a trusted lawyer to her clients, having been recognised by Best Lawyers for her expertise in Retirement Villages and Senior Living Law since 2013.
Illana is a Principal in Russell Kennedy’s Wills and Estate Planning team is a Law Institute Wills & Estates Accredited Specialist. Her practice includes the creation of Enduring Powers of Attorney and Appointments of Medical Treatment Decision Makers as well as acting for and against substitute decision makers and their family members in relation to disputed matters concerning the appointments of these substituted decision makers.
