Online Training | Balancing Duty of Care and Dignity of Risk in Aged Care

Who should attend: This online training is relevant to managers, supervisors, team leaders, front line staff and volunteers in home care and residential aged care.
The emphasis on consumer choice and dignity of risk will have even greater prominence under the New Aged Care Act.
Aged care providers must understand their obligations with respect to consumers’ choice to take risks and live the life of their choosing, regardless of the possible consequences. However, the concepts of dignity of risk and duty of care are often poorly understood and is a difficult area for providers in a highly regulated environment.
This training will assist providers and their workers understand their legal obligations with respect to dignity of risk, as well as where to draw the line when the risk is too high.
In this training session, our presenters will discuss:

Legal obligations with respect to dignity of risk.

The balancing act between dignity of risk and duty of care.

Understanding who can make choices for a care recipient where the care recipient is unable to do so.

Risk mitigation strategies and how to fulfil dignity of risk obligations.
We will use case studies to explore the concepts and help staff feel more confident in understanding what choices they are required to respect and when they should say no.

Anita Courtney, Principal in Russell Kennedy’s Aged Care team will facilitate and deliver the training. Anita is a leading lawyer in aged care who focuses on delivering quality and practical advice to her clients. She assists aged care providers in both home care and residential care to comply with their responsibilities under the Aged Care Act 1997 and its Principles including the Aged Care Quality Standards as well as other relevant laws.
Johanna Heaven, Associate in the Russell Kennedy Aged Care team will also present in the training. Johanna practices in the areas of aged care, administrative law, litigation, regulatory compliance and risk management, with a focus on health and government.
