Who should attend: This online training is relevant to residential aged care managers as well as those working in admissions and finance/accounts. 
 

In this training session, our presenters will discuss: 

• Recover of resident debts from their estates in complex situation.

• Debt Payment of RADs to third parties or when there is no grant of Probate or Letters of Administration.
  
  The training will cover: 

• The Probate process and what to do if you don't know if there is a Will, who the executors is or if no one is taking responsibility for the administration of the estate and you are stuck with the RAD (with interest!).

• Dealing with third party RAD requests. Should you agree to refund the RAD to a third party and what safeguards can you put in place if you do?

• Pitfalls in paying a RAD without a Grant of Probate or Letters of Administration.

• What is involved in recovering a debt when there are complexities surrounding the administration of the resident's estate.

• Dealing with next of kin and substitution decision makers to recover payment of a debt when the resident does not have capacity.

The session will be presented by Anita Courtney and Ilana Kacev who both regularly assist aged care providers.

Anita Courtney, Principal in Russell Kennedy’s Aged Care team will facilitate and deliver the training. Anita is a leading lawyer in aged care who focuses on delivering quality and practical advice to her clients. She assists aged care providers in both home care and residential care to comply with their responsibilities under the Aged Care Act 1997 and its Principles including the Aged Care Quality Standards as well as other relevant laws.

Ilana Kacev, Principal in the Russell Kennedy's Wills & Estate Planning team will also present in the training. Ilana is a Law Institute Wills & Estate Accredited Specialist. Whether it be creating an estate plan, resolving an estate dispute or protecting those in vulnerable positions, Ilana is able to provide clear and straightforward advice by evaluating her client's circumstances and identifying practical solutions to their problems.
