1. ASSUMPTION OF RISK
The Participants hereby acknowledge and agree that the Participant understands the nature of the Event and is participating voluntarily in the Event; that there are certain inherent risks and dangers associated with the Event, including but not limited to: inherent danger, variations in the conditions, collisions with objects such as trees, rocks, barriers, equipment, employees, volunteers, other patrons, equipment failure; lack of safety devices or inadequate safety devices; lack of warnings or inadequate warnings; lack of instructions or inadequate instructions; and that, except as expressly set forth herein, Participant, knowingly and voluntarily, accepts, and assumes responsibility for, each of these risks and dangers, and all other risks and dangers, whether known or unknown, that could arise out of, or occur during, Participant’s participation in the Event even if such risks are due to the negligence of The Utopia Frequency and/or their agents, contractors, volunteers or employees.
I AM AWARE THAT THE ACTIVITIES AT THE EVENT ARE HAZARDOUS ACTIVITIES AND THAT I COULD BE SERIOUSLY INJURED OR EVEN KILLED. I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED, AND AGREE TO ASSUME ANY AND ALL RISKS OF BODILY INJURY, DEATH OR PROPERTY DAMAGE, WHETHER THOSE RISKS ARE KNOWN OR UNKNOWN.

2. RELEASE AND WAIVER
The Participants hereby release, waive, discharge, and covenant not to sue the The Utopia Frequency, its affiliated programs, their respective administrators, directors, agents and other employees of the Event, other participants, sponsoring agents, advertisers, volunteers, and, owners, operators and lessors of premises used to conduct the Event (collectively, the “Releasees”), from and for any liability resulting from any personal injury, accident or illness (including death), and/or property loss or damage, however caused, even if caused by the negligence of the The Utopia Frequency and/or their agents, contractors, volunteers or employees , arising from, or in any way related to, Participant’s participation in the Event.
I also agree that I, my assignees, heirs, guardians, next of kin, spouse and legal representatives will not make a claim against, sue, or attach the property of any Releasee in connection with any of the matters covered by the foregoing release.

3. INDEMNIFICATION AND HOLD HARMLESS
The Participants hereby agree to indemnify, defend and hold the Releasees harmless from any and all claims, actions, suits, expenses, damages and liabilities procedures, costs, bodily injury, property damage, wrongful death or otherwise which may arise out of the Participant’s use of any equipment or participation in the Event activities including, but not limited to, attorney’s fees, arising from, or in any way related to, the Participant’s participation in the Event.
I specifically understand that I am releasing, discharging, and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the representatives, employees, and affiliates of The Utopia Project from any and all claims, actions or losses incurred by participating in the Event.

4. NO REFUND
The Participants agree that the tickets of the Event are NON-REFUNDABLE. In particular instances this may be appealed and considered in individual case. This can be done by emailing theutopiafrequnecy@gmail.com with "Refund Request" within subject header with stated reason and justification. These requests will be considered on a case-by-case basis and may be granted in extreme cases.

5. LIKENESS
The Participants hereby agree, without compensation, to allow the Participant’s image, photograph, video reproduction or likeness to appear in publications, advertising, and/or television and online coverage in any manner incidental to his/her participation.

6. SEVERABILITY
The Participants expressly agree that the foregoing assumption of risk, release and waiver of liability, indemnity and consent agreement is intended to be as broad and inclusive as is permitted by the law of the State of United Kingdom, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

7. ACKNOWLEDGMENT OF UNDERSTANDING
The Participants have read this assumption of risk, release and waiver of liability, indemnity and consent agreement, and have had the opportunity to ask questions about the same. The Participants fully understand this assumption of risk, release and waiver of liability and indemnity agreement, that the Participants are giving up substantial rights in connection therewith, and that its terms are contractual, and not a mere recital. The Participants acknowledge that they are agreeing to this agreement freely and voluntarily and that no oral representations, statements, or inducements, apart from the foregoing written agreement have been made.

By proceeding in booking you are accepting of all terms and conditions stated above.

The Utopia Frequency reserves the right to amend these Terms and Conditions.

TERMS AND CONDITIONS

All issues relating to the sale of tickets and the hosting of their associated event(s) are the responsibility of the account holder known herein as the “Event Organiser” using the TryBooking UK Ltd website to manage this event and not that of TryBooking UK Ltd., its subsidiaries, affiliates, officers, agents, other partners and employees known herein as “TryBooking UK”. 1. TryBooking UK is not responsible for the Terms and Conditions or any other instructions or directives imposed by the Event Organiser. 2. TryBooking UK is not liable for any loss or damage arising from the purchase of this ticket. 3. TryBooking UK cannot exchange or refund this ticket. 4. The additional booking fee that may apply when purchasing tickets via the TryBooking UK Ltd website is not negotiable or refundable and can be subject to change at TryBooking UK's sole discretion. 5. A cancelled, postponed or altered event does not constitute an obligation by TryBooking UK to substitute, refund or provide other compensation monetary or otherwise. 6. Any dispute which may arise regarding the booking of this event or the way in which this event is conducted or the conditions in which this event is held is solely between the ticket holder and the Event Organiser and not a part of TryBooking UK's responsibilities.
